1. Agreement to Terms

By accessing or using TrustKit ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

TrustKit is a B2B SaaS platform that enables businesses to collect client testimonials and generate AI-powered case studies. The Service includes:

  • Case study creation and management tools
  • AI-powered content generation using OpenAI technology
  • Magic link workflow for client feedback collection
  • Export capabilities (PDF, web embed, social media kits)
  • Subscription-based features based on pricing tiers (STARTER, PRO, AGENCY)

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and accept all risks of unauthorized access
  • Notify us immediately of any breach of security or unauthorized use of your account
  • Be responsible for all activities that occur under your account

You may not use the Service if you are under 18 years of age or if your account has been terminated by us.

4. Subscription Plans and Billing

TrustKit offers multiple subscription tiers:

  • STARTER: Free plan with limited features
  • PRO: 29€/month with advanced features
  • AGENCY: 99€/month with unlimited features

By subscribing to a paid plan, you agree to:

  • Pay all applicable fees for your subscription plan
  • Provide current, complete, and accurate billing information
  • Automatic renewal of your subscription unless cancelled before the renewal date
  • All payments are processed securely through Stripe

You may cancel your subscription at any time through your account settings or by contacting us. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months.

5. User Content and Intellectual Property

You retain all rights to the content you submit to the Service ("User Content"), including client testimonials, case study data, logos, and images. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing the Service to you.

You represent and warrant that:

  • You own or have the necessary rights to all User Content you submit
  • Your User Content does not infringe any third-party intellectual property rights
  • You have obtained all necessary permissions from your clients to use their testimonials and personal information

6. AI-Generated Content

TrustKit uses artificial intelligence technology (OpenAI) to generate case study content based on the information you provide. You acknowledge and agree that:

  • AI-generated content is provided as-is and should be reviewed before publication
  • You are solely responsible for reviewing, editing, and approving all AI-generated content
  • We do not guarantee the accuracy, completeness, or quality of AI-generated content
  • You must obtain client approval before publishing case studies containing their information

7. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Submit false, misleading, or fraudulent information
  • Transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to the Service or its related systems
  • Use the Service to harass, abuse, or harm another person
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Resell or redistribute the Service without authorization

8. Service Availability and Modifications

We strive to provide reliable service but do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We reserve the right to:

  • Modify, suspend, or discontinue the Service at any time
  • Change pricing and features of subscription plans with 30 days notice
  • Perform scheduled and emergency maintenance
  • Impose usage limits or restrictions

9. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as detailed in our Privacy Policy.

You are responsible for ensuring that your use of the Service complies with all applicable data protection laws, including GDPR, CCPA, and other privacy regulations. You must obtain appropriate consent from your clients before collecting and processing their personal data through our Service.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • You will lose access to all content and data associated with your account
  • We recommend exporting your data before cancelling your subscription
  • All provisions of these Terms that should reasonably survive termination will survive

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

IN NO EVENT SHALL TRUSTKIT, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless TrustKit and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where TrustKit is registered, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
